Terms of Service
Version 2026-10-25-draft · [Hallkin legal entity name]
These terms cover Hallkin, the service [Hallkin legal entity name] (“Hallkin”, “we”) provides to homeowners associations (“associations”) and to the people who use it for them: board and committee members, managers and homeowners (“you”). An association agrees to them, with the Data Processing Addendum, when it signs up; each person agrees when they first sign in.
1. What Hallkin does
Hallkin helps an association run itself: its governing documents in one searchable place, answers to members' questions drawn from those documents with citations, architectural (ACC) applications, maintenance requests and rule concerns, letters and notices, and a record of who did what.
2. AI assists; people decide
- Answers, application checks, summaries and drafts come from AI working only from your association's own documents. They can be wrong or incomplete. Always check the cited passages.
- Hallkin is not a lawyer and doesn't give legal advice. It doesn't decide which of two conflicting provisions controls; it points the conflict out for people to resolve.
- Every decision with consequences (approving or denying an application, sending a letter, acting on a concern) is made and approved by a person, and recorded. See How Hallkin uses AI.
3. Accounts
- Hallkin is invite-only. Use your own account, keep your password and authenticator safe, and tell your association if they're lost.
- Board, committee and administrator roles must use two-step sign-in.
- Your association decides who has an account and which roles they hold, and can remove access.
4. Acceptable use
You agree not to:
- use Hallkin for anything unlawful, or to harass, threaten or defame anyone;
- knowingly file false reports. A rule concern is an allegation for the board to look into, never a finding;
- upload files you don't have the right to share, or files meant to harm (Hallkin rebuilds uploads, but don't try);
- try to see another association's or another person's information, probe or overload the service, or copy it at scale;
- use AI features to generate content unrelated to your association's business.
5. Your association's information
- The association owns what it and its members put into Hallkin: documents, records, requests and messages. Hallkin uses it only to provide the service to that association, as the association's processor under the Data Processing Addendum.
- Hallkin doesn't sell personal information, show ads, or let AI providers train their models on association data.
- The association is responsible for having the right to upload its documents and member information, and for the decisions it makes in Hallkin.
- When an association leaves, it can ask for an export of its records; Hallkin then deletes them as the Privacy Policy describes.
6. Availability and changes
Hallkin is in a pilot. We work to keep it available and your data safe, but can't promise it will always be available or error-free. We may change features. If we change these terms in a way that matters, we'll tell associations in advance, and you'll be asked to accept the new version the next time you sign in.
7. Fees
Fees, if any, are set in the association's agreement with Hallkin. Homeowners don't pay to use Hallkin.
8. Disclaimers, liability and indemnity
[To be written by counsel: warranty disclaimer, limitation of liability, and indemnity terms appropriate to a service for Florida associations.]
9. Ending use
An association can stop using Hallkin under its agreement. We may suspend an account that breaks these terms, after notice where we can give it. Sections 5 and 8 continue after use ends.
10. Law and contact
These terms are governed by the laws of Florida, and disputes go to the courts of [County], Florida. Questions: [support email], [Mailing address].
